First hearing for Sask. LGBTQ2 group lawsuit over government pronoun policy in schools announced

“UR Pride, along with representatives from Egale Canada and McCarthy Tetrault LLP, recently met with the chief justice in Regina to discuss their plans to file a lawsuit against the Saskatchewan government. The lawsuit focuses on the province’s new pronoun policy, which requires parental consent for children under 16 to use different names or pronouns at school. The first hearing for the case has been scheduled for September 19, and the director of legal at Egale Canada, Bennet Jensen, expressed satisfaction with the quick timeline. Jensen emphasized the importance of a public hearing, as the policy affects many people in the general public. However, Jensen also expressed concern for the well-being of trans students during the case and while the policy is in effect, fearing that they may feel marginalized, outed, or misgendered.

The government of Saskatchewan, along with all 27 school divisions in the province, is named as respondents in the court application. The government released a statement asserting its commitment to implementing the policy and protecting parental rights. Both sides will have the opportunity to present their arguments for or against the policy starting on September 14.

While the outcome of this lawsuit remains uncertain, the case raises important questions about the rights of transgender and gender-diverse students in educational settings. It highlights the delicate balance between protecting parental rights and ensuring the well-being and inclusivity of all students. As this legal battle unfolds, it is crucial to consider diverse perspectives and to promote dialogue that fosters empathy and understanding. Ultimately, the resolution of this case will have far-reaching implications for the rights and experiences of transgender students, and it is a conversation that should be followed closely.”
